HopaHop Terms and Conditions

Version 1.5, 21 October 2026. English translation for information; these terms are drafted in Romanian (clause 17.3).

1. Who we are and what HopaHop is

1.1 HopaHop (hopahop.eu) is an online platform operated by PFA BRATU COSMIN ALEXANDRU, registered with the Trade Register under EUID ROONRC.F2026014445008, tax ID (CUI) 54272691, registered office in Alexandria, Teleorman county, email [email protected], phone 0766 222 233 ("HopaHop", "we").

1.2 HopaHop is a carpooling platform: it connects drivers who are making a trip anyway, for their own needs, with people who want to travel with them and share the costs, especially passengers with bulky luggage (for example musical instruments) or with pets.

1.3 HopaHop is only an intermediary. It is not a carrier, does not own vehicles, does not employ drivers and is not a party to the travel arrangement between driver and passenger. HopaHop is not a taxi, ridesharing or on-demand transport service.

1.4 By creating an account or using the platform you accept these Terms and Conditions. If you do not agree, do not use the platform.

2. Definitions

"Carpooling": the shared use of a private vehicle, for a trip the driver is making anyway, with the costs shared among those in the vehicle, without profit.

"User": any person with an account on the platform. The same account can publish rides and book seats.

"Driver": the user who publishes a ride. "Passenger": the user who books a seat on a ride.

"Ride": a trip published by a driver, with route, date, time, seats, price and conditions.

"Driver's price": the amount per seat set by the driver for the ride.

"Commission": the amount HopaHop automatically adds on top of the Driver's price for its intermediation services (see section 5).

"Booking": a passenger's seat on a ride, confirmed once the commission is paid.

3. Your account

3.1 You need an account to use the platform. You may create one only if you are at least 18 years old and have full legal capacity.

3.2 The details you give (name, phone, email) must be real and up to date. You must update them if they change.

3.3 An account belongs to one person and cannot be transferred. You may not have several accounts, especially to get around a suspension or a sanction.

3.4 You are responsible for your password. If you suspect someone has used your account, tell us immediately.

3.5 There is a single type of account: in the same app you can be both a driver and a passenger.

3.6 Your phone number is not shown to other users except under the conditions in section 6.

3.7 We send you notifications in the app and by email about your rides, bookings, reviews and penalties. You can turn off notification emails in the app; in-app notifications stay on.

3.8 From Notifications you can turn on browser or phone notifications, save route alerts (at most 5) to be told when a ride appears on your route, and invite friends with a personal code. You can turn these off at any time. Your driver profile (name, member since, whether you are verified, score, average rating, number of rides completed and the latest comments received, without the names of their authors) is visible to signed-in users.

3.9 You can add a profile photo, which must be a clear photo of your face only. Passengers see drivers' photos, and a driver sees the photos of passengers who booked with them. We may delete a photo that does not follow these rules (for example with other people or inappropriate content), and you can upload another one.

4. Publishing rides (rules for drivers)

4.1 You may only publish a ride you are actually going to make anyway, for your own needs, in a vehicle you are entitled to use. You may not create a ride only to carry passengers for payment. To publish rides you must verify your identity by sending a photo of your identity card, driving licence or passport. Your phone reads the name and birth date on the document and HopaHop compares them automatically with your account: if they match, your account is confirmed on the spot. If they do not, you can send the photo to HopaHop staff to check by hand. The photo is deleted right after the check, as described in the Privacy Policy. Exception: a share of automatic confirmations, picked at random, is also checked by a person on the HopaHop team; the photo is then kept for at most 7 days and deleted. We may withdraw a verification at any time if we learn the document is not yours or does not match your account; we tell you why, and you can send a document again.

4.2 You declare that you hold a valid driving licence, that the vehicle is registered, has a valid roadworthiness test (ITP) and motor liability insurance (RCA) in force, and that you are not banned from driving.

4.3 The information in the listing (route, date, time, free seats, car, accepted luggage and pets, notes) must be correct and complete. You may not offer more seats than the vehicle has. You may not publish the same ride twice (same route, same day) or rides that overlap in time.

4.4 Carpooling means sharing costs, not making money. The total amount all passengers pay (the Driver's price) may not exceed the cost of the trip (fuel, tolls, parking, wear), and the driver also bears their own share of the costs. You may not make a profit or use the platform to carry people for payment without the authorisations required by law.

4.5 You alone are responsible for complying with the traffic and tax rules that apply to you, including declaring income where applicable.

4.6 You must turn up at the place and time in the listing. If you cannot make it, tell the passengers and HopaHop as soon as possible.

4.7 We may refuse or delete a listing that breaks these terms or the law.

5. Price and commission

5.1 The driver sets the Driver's price for each seat.

5.2 HopaHop automatically adds a 10% commission on top of the Driver's price. The passenger sees the total price in the listing, split into commission and the driver's price. Passengers who have taken more trips pay a reduced commission (clauses 5.10–5.12).

5.3 The passenger pays the commission online, by card, when booking. The passenger pays the Driver's price directly to the driver, in cash, at the start of the trip.

5.4 Example: the driver sets 40 lei per seat. The passenger sees 44 lei: 4 lei commission paid in the app and 40 lei paid in cash to the driver.

5.5 The commission is payment for HopaHop's intermediation services and is not shared with the driver. HopaHop does not collect or keep the Driver's price.

5.6 The operator is not registered for VAT, so no VAT is added to the commission.

5.7 Card payments are processed by ING Bank N.V. Amsterdam – Bucharest Branch, through its ING WebPay online payment service. HopaHop does not see or keep your full card details.

5.8 You may not avoid the commission, for example through arrangements outside the platform made before booking, or by asking for or offering payment in another way for a ride published on HopaHop.

5.9 We may change the commission rate for the future, with prior notice. The change does not affect bookings already paid.

Passenger rewards

5.10 Passengers get a commission discount based on the number of trips taken as a passenger through HopaHop, at any time, with no time limit: the Ruby level, from 5 trips, takes 5% off the commission; Sapphire, from 10 trips, 8%; Diamond, from 15 trips, 10%. Example: on a 4 lei commission, a Sapphire passenger pays 3.68 lei.

5.11 Every 20 trips taken earn the passenger one trip without commission, applied automatically to the next booking. If that booking is declined, expires or is cancelled, the trip without commission stays available for a later booking.

5.12 Only completed trips count; a trip the passenger did not show up for does not. The discount is worked out and applied automatically at booking, shown in the price before booking and recorded on the booking. The passenger is told in the app each time they reach a new level and when they earn a trip without commission. The level appears on the passenger's profile and is visible to drivers, next to the ratings. Rewards are personal, cannot be transferred and cannot be exchanged for money. We may change or end the programme for the future, with prior notice (clause 14.1); discounts already applied and trips without commission already earned remain valid.

6. Booking and contact details

6.1 The passenger books a seat by pressing "Book" and paying the commission. One booking covers one seat for one person.

6.2 The booking is confirmed when the payment processor confirms the payment. From that moment one seat is taken off the ride.

6.3 Once the payment is confirmed, the driver and the passenger see each other's phone number and can call or message each other on WhatsApp. The number may be used only to organise this trip. Using it for advertising, harassment, recordings or any other purpose is forbidden.

6.4 The travel contract is made between the driver and the passenger. HopaHop is not a party to it.

6.5 By booking, the passenger agrees to arrive on time and to pay the driver the Driver's price.

6.6 A passenger can publish a request (at most 5 active), with the route, the departure window (earliest and latest date and time), luggage and pet. The request is visible to signed-in drivers, with the passenger's first name, and closes when the passenger books a ride linked to it, cancels it, or it expires. A passenger may have only one active request for a given time window: the windows of their requests cannot overlap.

6.7 A driver who answers a request publishes a ride on the requested route and within the requested window and must send the passenger a message. The passenger is notified in the app and by email.

6.8 Messages, requests, listings, reviews and profile names may not contain phone numbers (including written out in words, for example "zero seven...", or with separators), email addresses, links or references to messaging apps. HopaHop checks these texts automatically, and texts that seem to contain such details are blocked and not sent. The check is automatic and may sometimes block a harmless text; if so, rephrase it. Phone numbers become visible only after the commission is paid, as set out in section 6.3.

6.8.1 The passenger and the driver can communicate through the platform (messages) only after the commission is paid. Until then, texts the other person reads (Ia-mă nene requests, questions under 6.9 and their answers, the message with which a driver answers a request) may not contain, besides the details in 6.8, meeting places or times (for example stops, stations, the metro, petrol stations, car parks, malls, squares, "see you at…", "at 7", "7:30") or any other wording that would let the two meet without paying the commission. Texts that break this rule are blocked with the message "This message does not comply with the HopaHop Terms and Conditions".

6.8.2 The driver's notes on a ride (for example the exact meeting place and time) are seen only by a passenger who has paid the commission, like the phone number and the exact address.

6.9 Before booking, a passenger may send the driver at most 3 short questions per ride (for example about luggage or pets), and the driver may answer. The meeting place and time are not arranged here but after the commission is paid (6.8.1, 6.8.2). Only the two of them see the questions and answers, which are subject to the rule in section 6.8.

6.10 The driver may optionally fill in the street and number of the departure and destination. The exact address becomes visible to the passenger only after the commission is paid, like the phone number, and is subject to the rule in section 6.8.

7. Luggage, pets and children

7.1 The listing shows which large luggage and which pets the driver accepts (and whether a pet travels in a transport carrier or on the back seat), whether the driver has a child seat and whether smoking is allowed in the car. If the listing does not allow smoking, nobody smokes in the car. The passenger carries only what the listing accepts.

7.2 Carrying weapons, dangerous or illegal substances and other items prohibited by law is forbidden.

7.3 Pets may travel only if the listing allows it. The passenger is responsible for the pet: its health, the vaccinations and documents required by law, safe transport (in a carrier or on a harness, as appropriate) and any damage it causes.

7.4 The driver may refuse a pet that seems ill or dangerous and may ask for the pet to be kept in a carrier, within the limits of the listing.

7.5 Musical instruments and other fragile items are packed and secured by the passenger. Liability for damage is settled between passenger and driver, according to the law.

7.6 When booking, the passenger declares the weight and volume of large luggage and the weight of the pet, within the limits the driver set in the listing. The declaration must be accurate. If the luggage or pet exceeds what the passenger declared or the listing's limits, the driver may refuse to carry them or the passenger, in which case the commission is not refunded.

7.7 A passenger may travel with minor children only if they declare them when booking or in a "Ia-mă nene" request: how many and each child's age. Children aged 1 or more take a seat each, paid like any seat. Children under 1 do not take a separate seat in the booking.

7.8 Minors may not travel unaccompanied. The passenger who books accompanies the children for the whole trip and is responsible for them: they are the parent, the guardian or a person authorised by them, and carry the documents the law requires for the minor's trip.

7.9 Children for whom the law requires a child restraint (child seat) travel only in an approved child seat suited to their age, height and weight. The passenger brings and fits the seat, unless the listing shows that the driver has a child seat. Even then, the passenger checks before departure that the seat suits the child. HopaHop does not check child seats and is not responsible for choosing or fitting them.

7.10 A driver who ticks that they have a child seat undertakes to have it in the car, in good condition, at departure. If they tick it and do not have it, HopaHop may take the measures in section 11.

7.11 The driver may refuse to carry a child who was not declared or for whom there is no suitable child seat, in which case the commission is not refunded. Either party may ask the HopaHop team to look into it.

8. Cancellations, no-shows and refunds

8.1 If the driver does not show up, the passenger can report it from "My bookings", from 30 minutes after the departure time and up to 48 hours after it.

8.2 After the report, the ride is cancelled and the commission paid by the passenger is refunded in full, by the same payment method. How long it takes for the money to appear in your account depends on your bank.

8.3 A driver who did not show up receives 20 penalty points for that ride. The penalty is applied once per ride, however many passengers reported it.

8.4 A driver's score starts at 100 points, is shown in listings and can become negative. A driver with a score of 40 or less can no longer publish rides. You can ask for the case to be reviewed at the contact address.

8.5 False or abusive reports may lead to suspension or closure of the account. We may check reports and ask both parties for explanations.

8.6 If the driver cancels the ride before departure, the affected passengers get the commission refunded.

8.7 If the passenger cancels the booking less than 24 hours before pickup or does not show up, the commission is not refunded, except when the ride is cancelled by the driver or by HopaHop.

8.8 If the passenger is more than 15 minutes late compared with the time in the listing without letting the driver know, the driver may leave without them, with no refund.

8.9 In case of force majeure (for example severe weather or a closed road), the driver may cancel the ride and the commission is refunded.

8.10 The passenger can cancel the booking in the app before departure. If they cancel at least 24 hours before the pickup time, they get back everything they paid in the app, including the commission. If they cancel later, section 8.7 applies. Before cancelling, the app shows the amount that will be refunded.

8.11 The driver can cancel the ride in the app before departure; all passengers with a paid booking get the commission back (section 8.6). If the driver cancels the ride or a paid booking less than 24 hours before departure, they lose 10 conduct points (sections 8.3–8.4), once per ride.

9. Safety, the Panic button and support

9.1 All users behave respectfully, without discrimination, harassment or violence. The driver does not drive under the influence of alcohol or other substances, and passengers wear seat belts.

9.2 The "Panic" button sends HopaHop an alert with your name, phone, email, the message you wrote and, if you ticked it, your location. The button is not an emergency service and does not guarantee an intervention. In immediate danger, call 112.

9.3 Alerts are handled daily, between 08:00 and 20:00. We cannot guarantee a particular response time.

9.4 False or repeated alerts without reason may lead to the account being suspended.

9.5 The HopaHop call centre can be reached at 0766 222 233, daily, between 08:00 and 20:00.

9.6 HopaHop does not check users' licences, insurance or records. The driver's score only reflects behaviour on the platform. Be careful and follow the usual safety rules.

9.7 You can report in the app a ride, a user, a comment or a question that breaks these terms. Reports are reviewed by HopaHop staff, who may hide the content, penalise or suspend the account. False or repeated reports without reason may lead to the reporter's account being suspended.

10. What is not allowed

10.1 Giving false or misleading information.

10.2 Using the platform as a taxi, ridesharing or other paid transport service without the authorisations required by law.

10.3 Getting around the commission or exchanging contact details outside the platform before the booking is paid, including by hiding phone numbers in texts (letters, symbols, split messages).

10.4 Harassing, threatening or discriminating against other users.

10.5 Posting illegal content or content that infringes the rights of others.

10.6 Accessing the platform without authorisation, scraping it or loading it artificially.

10.7 Sending unsolicited messages (spam) to other users.

11. Suspension and closure of the account

11.1 You can close your account at any time by sending a request to the contact address. Active bookings must be honoured or cancelled according to section 8.

11.2 We may suspend or close an account for breaking these terms, for fraud, for safety risks or for a score below the limit in section 8. We will tell you when possible. A suspended account cannot sign in, publish or book rides. You can contest the suspension at the contact address, and the case is reviewed by a person.

11.3 Closing the account does not cancel obligations that already exist, for example refunds in progress.

12. Liability

12.1 To the extent permitted by law, HopaHop is not liable for users' acts or omissions, for the quality, delay or cancellation of trips, for the luggage or pets carried, or for accidents.

12.2 HopaHop does not provide insurance. The trip is covered, where applicable, by the driver's motor liability insurance (RCA).

12.3 The platform is provided "as is". We make efforts to keep it running, but do not guarantee it will be free of interruptions or errors.

12.4 Nothing in these terms excludes liability for intentional acts or gross negligence, for personal injury, or rights that cannot be limited by law, including consumer rights.

12.5 Where the law allows, HopaHop's liability towards a user is limited to the commission paid for the booking concerned.

13. Personal data

13.1 Your personal data is processed according to the HopaHop Privacy Policy, available in the app, which forms part of these terms. It explains what data we process, why, who we share it with, how long we keep it and what rights you have.

13.2 Once the commission is paid, the driver and the passenger see each other's phone number (see section 6). The driver's name and score are visible to signed-in users.

13.3 Penalties and drivers' scores are applied automatically. You have the right to ask for the case to be reviewed by a person (see section 8.4 and the Privacy Policy).

13.4 To exercise your rights you can write to us at [email protected]. You have the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing (ANSPDCP).

14. Changes to these terms

14.1 We may change these terms. We will tell you in the platform or by email before the changes take effect. If you keep using the platform after that date, you accept the new terms. If you do not agree, you can close your account.

14.2 Bookings already paid remain subject to the terms in force on the date of the booking.

15. Complaints and disputes

15.1 For questions or complaints you can contact us at 0766 222 233 or at [email protected].

15.2 If you are a consumer, you can contact the National Authority for Consumer Protection (ANPC) or an alternative dispute resolution (SAL) body.

15.3 These terms are governed by Romanian law. Disputes are settled by the competent courts, according to the law.

16. Reviews and comments

16.1 After a ride, the driver and the passenger can give each other a rating from 1 to 10 and a comment. Reviews are possible only for paid bookings, from 30 minutes after the departure time and up to 30 days after it.

16.2 The order is fixed: the driver reviews the passenger first. Only after that is the passenger notified in their account and able to review the driver.

16.3 A review must be honest, relate to that trip and be respectful. Insults, threats, other people's personal data, and discriminatory or illegal content are not allowed.

16.4 A review cannot be changed or withdrawn after it is sent. If a review about you is false or abusive, you can ask for it to be checked at the contact address.

16.5 A driver's average rating and number of reviews are shown in their listings, and the comments are visible to signed-in users. Reviews received by a passenger are visible to the passenger and to the person who wrote them.

16.6 HopaHop may hide or delete reviews that break these terms. You may not ask for or offer benefits in exchange for ratings.

16.7 Reviews express users' opinions, not HopaHop's. The review rating is different from the driver's conduct score in section 8.

17. Final provisions

17.1 If a provision of these terms is void or unenforceable, the others remain valid.

17.2 Acceptance of the terms when creating an account is recorded electronically, together with the date and the version of the terms accepted.

17.3 These terms are drafted in Romanian.
